Your booking or enrollment acknowledges your agreement to follow the below. Please read the Be You Ballroom Waiver & Release Form:

If at any time during a lesson or class, you feel discomfort or strain, gently come out of the posture. You may rest at any time during the class. It is important in Ballroom, Barre or DanceFIT that you listen to your body & respect its limits on any given day.You understand that Ballroom, Barre or DanceFIT include physical movements as well as an opportunity for relaxation, stress reduction & relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present & cannot be entirely eliminated.If you experience any pain or discomfort, you agree to listen to your body, discontinue the activity & ask for support from an instructor. You will continue to breathe smoothly. You assume full responsibility for any & all damages, which may incur through participation. You understand that Ballroom, Barre & DanceFIT is not a substitute for medical attention, examination, diagnosis or treatment. It is not recommended & is not safe under certain medical conditions. By signing or booking, you affirm that a licensed physician has verified your good health & physical condition to participate in such a program, if required. In addition, you will make the instructor aware of any medical conditions or physical limitations before class. If you are pregnant, become pregnant or I am post-natal or post-surgical, your booking verifies that you have your physician’s approval to participate.You also affirm that you alone are responsible to decide whether to practice Ballroom, Barre or DanceFIT participation is at your own risk. You hereby agree to irrevocably release & waiver any claims that you have now or may have hereafter against Be You Ballroom PTY LTD & all related facilities & premises for any personal injury or negligence. Additionally, the facility, instructor & Be You Ballroom PTY LTD are not in any way responsible for any loss or damage of your personal property.

Those under 18 years of age must have a completed enrollment form signed by a parent or guardian as a release & waiver.
If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect & the offending provision or provisions severed here from.
You have carefully read & fully understand & agree to the above terms of this Liability Waiver Agreement. You are in agreement voluntarily & recognise that your signature serves as complete & unconditional release of all liability to the greatest extent allowed by law & that it cannot be changed orally.

Classes:

*Please note that any class pass is to be used for classes consecutively.
ANY discount including 4 Week Block Pass or Kids All Class Pass payment applies whether the classes are consecutively attended or not. These passes are to encourage consistency in attendance & avoid class disruptions.
Alternatively if you would like to attend adult classes casually, please select the casual rate & book for each class you attend.
**You may start any time with the 4 week block starting from your first visit.Kids Classes must be paid for by in full by semester whether attended to or not.

Booking Policy:

Be You Ballroom Booking Policy will be strictly adhered to out of respect to the studio & others who would like to participate in lessons or classes. The studio implements a booking policy to prevent disruption to business caused by late cancellations & rescheduling. Please understand that late cancellations or no shows means that others miss the opportunity to participate.

Private Lessons & Wedding Lessons:

Any type of Private Lesson booking including Wedding Lessons will not be secure unless a 50% deposit is paid in advance. If this deposit is not in place, this time slot will be offered to other enquiries. Consistent weekly bookings will need to acknowledge this deposit at the end of the prior lesson weekly.
Lessons must be paid with future deposit at the end of a lesson, not at a later time.Cancellations or reschedules must be made at least 48 hours prior to a lesson. If this timeframe is not adhered to, the booking deposit will be absorbed. If another lesson is to be booked, a deposit for the future lesson must be made to secure the time otherwise this time will be offered to other bookings. Deposits are non-refundable or exchangeable.
The studio/teachers withhold to right to reschedule or cancel as needed with an alternative time to be offered to make up for the booking.
A medical certificate may be presented for illness reschedules with the booking to be rescheduled not cancelled, otherwise the deposit will be taken.Private Lessons are limited with only a set designated amount of time available & are highly sought after with waiting lists for bookings. For this reason, the Booking Policy applies to avoid timetable disruption & loss of business.

Classes:
We do not offer refunds for change of mind on any lesson type including adult & kid group classes, social events or private lessons. All classes must be paid for whether they are attended or not regardless of how you pay or whether you choose to attend casually or by the block.Class sizes are limited & therefore your booking secures a place in the class that will no longer be available to others.

Kids Classes:
A non-refundable $50 registration must be paid upon registration once a year for administration & insurance purposes for Medal Classes. A non-refundable $15 registration must be paid upon registration once a year for administration & insurance purposes for any other class type such as Competition & Troupe classes.

Any use of Service NSW Vouchers is non refundable & not exchangeable for cash. Vouchers can only be used on group classes not uniforms, private lessons, costuming, competition of performance troupes by Service NSW terms.
Once registered, payment for a semester (Term 1 & 2, or Term 3 & 4) is to be paid whether attended or not. This is to cover to limited class numbers that are available. Costume fees & Medal fees for the semester are required to be paid at the start of the semester. Costume fees are only refundable if not yet purchased, however Medals are booked at the beginning of the semester & are not refundable for this reason. Should a costume exceed the costume fee, the studio will cover the excess (within reason). Each class may have a costume, so please keep this in mind when registering for multiple classes. Troupes are a commitment for the semester & it is expected that a child sees to this commitment unless extraordinary events such as injury etc.

Uniforms:
Kids Classesforms are a requirement upon enrollment & must be worn any time in the studio or participating in a BYB event. Uniforms must be worn in classes & practice. Students are asked to attend classes dressed neatly in BYB Uniform & with correct footwear. Children will not be allowed to dance with just socks on their feet or no shoes. For safety reasons, children must wear dance shoes. We encourage all students to participate in classes in a clean, tidy, manner with hair secured.

General:

We may refund where required in accordance with the Australian Consumer Law. If you pre‐pay in advance for a ‘Package’ (a number of lessons), refunds for whole Packages will not be provided unless required in accordance with the Australian Consumer Law.

Photography/Filming is not permitted:

Video footage of class/performances/lessons/practice is not to be placed on social media without the consent of BYB. Photography or filming within the studio is prohibited without permission prior.

Note Taking:

Note taking is not permitted unless in your own class or lesson. Any note taking during a class or lesson that you are not attending will assume attendance & you will be charged attendance. This is out of respect to those participating in the class or lesson.

Kids Program:

- Payments are based on 10 week terms. Fees will be adjusted for terms that are not 10 weeks. Fee payment for the whole term must be made even if the student has missed a lesson.
- All Kids Private Lessons follow the private lesson booking policy.
- Semester installments can be made through your account on the Momence app once enrollment form has been completed with updated information or may be completed via the website.
- Kids Medal classes are prerequisites for participation in any other class or private lesson.- Kids classes have a drop off policy for all children to allow children to focus.
- A place in one of our classes is not available until an enrollment form has been fully completed & received. Fees are to be paid by semester.
No payment = No participation.
- Payment is welcome in the form of cash, direct deposit & via online booking to your momence account. BYB no longer sends invoices for classes. All classes must be paid for whether they are attended or not & regardless of if you pay by the term.
- Credits will be issued only if the teacher cancels a class.
- Payment fees/systems are non negotiable.
- All classes are determined by age. Students are required to complete a Medal Test to move through the levels of classes. Students must complete Medal Classes to be allowed to participate in competition or have a private lesson. Children are only to be enrolled in their designated age groups.

News & Communications:

BYB communicates all studio news & information to you in the form of a newsletter via email, studio social media, our 'be Part of BYB' Values Wall in the studio & our website. All urgent information will be sent via newsletter/email or text.Should a class be cancelled, a text message or email will be sent to those students/families affected.

Attendance: To reach full potential in class & perform well in Medal Exams, Showcases, Troupe & Competitions, students need to attend class on a consistent basis. Please notify BYB prior to class time if your child will not be attending their lesson to ensure BYB is aware of your child's safety. Should your child fall ill or suffer an injury, guardian details on the students enrollment form will be contacted & emergency directions followed.

Please note: All anaphylaxis students must bring their own Epipen to every class along with your anaphylaxis action plan upon enrollment.

BYB must be notified before class should your child be suffering from an injury, illness or allergy of any sort.

Please do not let your child attend if they are ill or have Influenza. All injuries obtained in class must be reported to the class teacher immediately.All areas of BYB are nut free zones.

Waiting Area/Viewing:

Kids have a student drop off policy.During other classes & private lessons please keep noise to a minimum, & refrain from congregating around any entry/exit doors or the main dance floor.
Please also encourage students & their siblings to sit quietly whilst they are waiting for a class. Parents must wait with their child until they have entered class & must collect children on time as we cannot be responsible for children outside of these classes.

Please respect our furniture & discourage your children from jumping on it. All dancers belongings are to be stored off the floor in compartments provided. Bullying - Kids & Adults: BYB value trust, loyalty, respect & honesty. We aim to provide a safe & secure environment for all members. To respect the rights of students, parents & staff, acts of bullying, harassment & intimidation will NOT be tolerated. We expect behaviour that promotes being respectful, civil & happy. Any form of bullying or harassment in the form of physical, verbal or written (including on any social media platforms) that is seen as hostile, humiliating, threatening or likely to bring fear or emotional distress, will not be tolerated.Immediate suspension of enrollment (without term refund) will be taken against any parties involved including parents. This bullying policy is not limited to just inside the dance studio. We do not take kindly to our students bullying members of other studios, nor do we like other studio’s students bullying our students. Please report any form of bullying & harassment to BYB as soon as it happens, being confident that the appropriate measures of discipline will be taken in confidentiality.

Any parents or adults gossiping or speaking inappropriately of any student including body shaming is not accepted & will result in expulsion of themselves or their children.

BYB reserves the right to cancel the enrollment of any member/student or their parents whose behaviour is disruptive or abusive, or who’s behaviour and/or comments in any form - verbal, written or online - that brings BYB & any members into disrepute.

Social Media:

We like to post photos or video on our Facebook, Instagram & social media pages about what our students are getting up to in class. Please make sure you acknowledge this on the enrollment form. If you do not wish for your child to appear on any social media platforms, please inform them of your decision so they are aware of why they are not included in any class photos. Please also discuss this with us. We do closely monitor all of our social media platforms & we are selective about who can view and share our content.

Etiquette - Kids & Adults:

Students & their parents are asked to be respectful of their teacher, other students & members. There is no need to ignore, speak derogatively or be aggressive with any BYB teacher or member. We do not accept rude behavior.

Please disconnect from technology whilst in class. We feel that since dance is a physical activity, there is no need for phones in class unless for emergency.

Arriving at class on time is important to minimise distraction & interruptions. Please be punctual on arrival. We do understand that being late is sometimes unavoidable, in which case, please contact the studio so appropriate care of your child can be arranged. Adults please turn your phone on silent during classes.

There is to be no food sent onto the dance floor with students. Bottled water only.

Intellectual Property:

For BYB teachers to maintain a controlled & positive learning environment, the dance floor is closed to parents/caregivers/siblings.
Please allow BYB teachers to teach & do not interrupt lessons. Teaching it is not permitted by a parent or any member that is not a teacher. All knowledge, methods, choreography, notes or information gained within education of BYB is intellectual property of Be YOU Ballroom PTY LTD. All students understand through bookings that this waiver prevents them from teaching or sharing this information inside or outside of the studio.

Consent:
By filling out an enrollment form or making a booking with BYB you consent to the following/have acknowledged the following:
* Paying all fees & associated costs on time & in full regardless of attendance Adult (Casual, Semester, Private Lessons, Note taking & 4 Class Pass) & Kids Classes (Semester)
* BYB assisting you, or your child in the event of illness, injury or accident & calling an ambulance if required
* Have noted on your enrollment form or momence account any injuries, illnesses, or allergies, & any treatment you or your child is having for said illnesses/injuries/allergies
* Physical contact where needed between the student and the teacher for correctional and/or first aid purposes
* Keeping all your contact details up to date with BYB
* You understand that BYB is not a substitute for medical attention, examination, diagnosis or treatment. It is not recommended & is not safe under certain medical conditions. By signing the enrollment form or making a booking it is acknowledged that a licensed physician has verified your child’s good health & physical condition to participate in such a program, if required. In addition you will make the instructor aware of any medical conditions or physical limitations before a class.
